Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the platform Ekipoo ("Service") operated by us. By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • "User" — any individual who registers an account on the Service (coach, athlete, parent, administrator).
  • "Coach" — a User who manages one or more Teams, athletes, training sessions, events, and related data.
  • "Athlete" — a User registered to one or more Teams who tracks their training and performance data.
  • "Content" — any data entered into the Service (athlete records, training plans, results, photos, attachments, announcements, chat messages).
  • "Subscription" — a paid plan that unlocks additional features, billed monthly or annually via our payment processor.

2. Account Registration

You must be at least 16 years old to create an account on your own behalf. Minors may participate as Athletes only when their account is created and managed by a Coach (or by a parent acting as legal guardian). You are responsible for keeping your password secure and for all activity under your account. You must provide accurate information and notify us promptly of any unauthorized access.

3. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose or to violate any third party's rights.
  • Upload, transmit or store malicious code, viruses, or any harmful content.
  • Attempt to gain unauthorized access to other accounts, systems or data.
  • Use automated tools (bots, scrapers) to extract data without our prior written consent.
  • Impersonate another person, falsify identity or upload data of athletes without their (or their guardian's) consent.
  • Resell, redistribute or sublicense the Service without our prior written consent.
  • Reverse-engineer, decompile or attempt to derive the source code of the Service.

4. User Content

You retain all rights to the Content you upload. By submitting Content you grant us a non-exclusive, worldwide, royalty-free license to host, store, process and display it strictly to operate and improve the Service for you. We do not claim ownership of your Content and we do not use it to train AI models or for advertising. Coaches are solely responsible for ensuring they have the right to upload data about athletes and minors, and for obtaining the necessary consents under the GDPR.

5. Subscriptions and Payments

Some features require an active paid Subscription. Pricing, billing cycle (monthly or annual) and the list of included features are shown on the Pricing page. Payments are processed by Paddle as Merchant of Record. Paddle handles taxes and refunds. Subscriptions renew automatically until cancelled. You may cancel at any time from your billing portal; access remains active until the end of the paid period.

6. Free Plan and Limits

A Free plan is available with limited capacity (e.g. number of teams, athletes, events). We may adjust these limits from time to time; the up-to-date values are shown in the application interface and on the Pricing page.

7. Refunds

Subscriptions are billed in advance and are non-refundable except where required by applicable consumer-protection law. EU consumers have the right to withdraw within 14 days of the first purchase, unless they have already started using paid features (in which case we may deduct the proportional value of the period used).

8. Service Availability

We strive to keep the Service available 24/7 but we do not guarantee uninterrupted operation. Scheduled maintenance, third-party outages, force majeure or upgrades may cause temporary unavailability. We are not liable for any loss resulting from such interruptions.

9. Intellectual Property

The Service — including its source code, design, trademarks, logos and original text — is owned by us and protected by copyright and other intellectual-property laws. No rights are transferred to you other than the limited right to use the Service while your account is active and in good standing.

10. Termination

You may close your account at any time from Profile → Data Management. We may suspend or terminate your account, with or without notice, if you breach these Terms, fail to pay due fees, or use the Service in a way that harms other Users or our infrastructure. Upon termination, personal data is deleted in line with our Privacy Policy.

11. Disclaimer and Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied. We do not warrant that performance data, time trials or statistics are error-free or fit for any specific use (including medical, scientific or competitive use). To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by e-mail and/or via an in-app banner at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy, without regard to conflict-of-law rules. The exclusive jurisdiction for any dispute is the competent court of the User's place of residence (for consumers) or, for business users, the courts of Milan, Italy.
